The relevance of the study lies in the fact that in the reforms of the system of compulsory enforcement of decisions stipulated the possibility of performing these functions by private enforcers. The purpose of the article is to consider problematic aspects of the legal status of a private enforcer as a participant of legal relations in the enforcement process. The results of the study contain generalizations on the analysis of the legal status of a private enforcer, proposals for amendments to (...) current legislation on private enforcers and the protection of the rights of the parties of enforcement proceedings. Finally, conclusions were formulated, which may be useful to practitioners of various legal professions such private enforcers, lawyers, judges, as well as citizens and legal persons, including those who are parties to the executive procedure. Immanuel Kant’s Observations on the Feeling of the Beautiful and the Sublime is examined in the context of the emergence of the epistemological practice of scientific observation. By focusing on the genre-stylistic and semantic-structural features of the text the authors demonstrate the mechanisms of observation as well as the methods of describing the results characteristic of mid-eighteenth century science. The authors consider Kant’s treatise to be a hybrid text: on the one hand, it attests to the importance of the natural (...) science paradigm and the degree of its influence on the humanities in the modern period; and, on the other hand, it bears witness to the multi-genre character of philosophical treatises, combining as they do the considered and serious wisdom of philosophy, the precision of scientific terminology and the figurativeness of a work of fiction. Kant is perceived not only as a researcher and philosopher capable of bringing out the essence of the particular and changeable captured in observation, but as a writer with a consummate command of the apparatus for keeping the reader’s attention through linguistic devices and practices of image-creating. The authors demonstrate how the categories of the “beautiful” and “sublime” become a general framework for the description of the moral and mental properties of human nature. The authors show that Kant’s use of “aesthetic” wording in the title of his treatise does not announce that his aim is analysis of artistic perception and practices, but mainly refers to the form of his anthropological study and conceptualisation of scientific knowledge. Kant has transferred the technique of visualisation from natural sciences to the objects of philosophical inquiry, thus contributing to the development in the humanities of representative practices, the scientific method of observation as well as the corresponding epistemic and literary genre. Emerging evidence suggests that DNA topology plays an instructive role in cell fate control through regulation of gene expression. Transcription produces torsional stress, and the resultant supercoiling of the DNA molecule generates an array of secondary structures. In turn, local DNA architecture is harnessed by the cell, acting within sensory feedback mechanisms to mediate transcriptional output. MYC is a potent oncogene, which is upregulated in the majority of cancers; thus numerous studies have focused on detailed understanding of its regulation. Dissection (...) of regulatory regions within the MYC promoter provided the first hint that intimate feedback between DNA topology and associated DNA remodeling proteins is critical for moderating transcription. As evidence of such regulation is also found in the context of many other genes, here we expand on the prototypical example of the MYC promoter, and also explore DNA architecture in a genome-wide context as a global mechanism of transcriptional control. Torsional stress, and supercoiling generated by transcription, shape the topology of DNA. Furthermore, the resultant secondary DNA structures and their interacting partners provide feedback to regulate gene expression. Emerging evidence suggests these mechanisms, identified through analysis of the MYC promoter, are applicable genome-wide. (shrink)

The processing, representation, and perception of bodily signals (interoception) plays an important role for human behavior. Theories of embodied cognition hold that higher cognitive processes operate on perceptual symbols and that concept use involves reactivations of the sensory-motor states that occur during experience with the world. Similarly, activation of interoceptive representations and meta-representations of bodily signals supporting interoceptive awareness are profoundly associated with emotional experience and cognitive functions. This article gives an overview over present findings and models on interoception and (...) mechanisms of embodiment and highlights its relevance for disorders that are suggested to represent a translation deficit of bodily states into subjective feelings and self-awareness. The present study examines cross-cultural differences in people’s concept of lying with regard to the question of whether lying requires an agent to _say_ something they believe to be false. While prominent philosophical views maintain that lying entails that a person explicitly expresses a believed-false claim, recent research suggests that people’s concept of lying might also include certain kinds of deception that are communicated more indirectly. An important drawback of previous empirical work on this topic is that only few studies (...) have investigated people’s concept of lying in non-Western samples. In the present study, we compare people’s intuitions about lying with indirect deceptions (i.e., presuppositions, conversational implicatures, and non-verbal actions) in a sample of _N_ = 255 participants from Russia and _N_ = 300 participants from the United Kingdom. Our findings show a strong degree of similarity between lie ratings of participants from Russia and the United Kingdom, with both samples holding it possible for agents to lie with deceptive statements and actions that do not involve the agent _saying_ something they believe to be false. Proximity and interpersonal contact are prominent components of social connection. Giving affective touch to others is fundamental for human bonding. This brief report presents preliminary results from a pilot study. It explores if exposure to bonding scenes impacts the activity of specific muscles related to physical interaction. Fingers flexion is a very important component when performing most actions of affectionate contact. We explored the visuo-motor affective interplay by priming participants with bonding scenes and assessing the electromyographic activity of the fingers (...) flexor muscle, in the absence of any overt movements. Photographs of dyads in social interaction and of the same dyads not interacting were employed. We examined the effects upon the electromyographical activity: during the passive exposure to pictures, and during picture offset and when expecting the signal to perform a fingers flexion task. Interacting dyads compared to matched non-interacting dyads increased electromyographic activity of the fingers flexor muscle in both contexts. Specific capture of visual bonding cues at the level of visual cortex had been described in the literature. Here we showed that the neural processing of visual bonding cues reaches the fingers flexor muscle. Besides, previous visualization of bonding cues enhanced background electromyographic activity during motor preparation to perform the fingers flexion task, which might reflect a sustained leakage of central motor activity downstream leading to increase in firing of the respective motor neurons. These data suggest, at the effector level, an implicit visuo-motor connection in which social interaction cues evoke intrinsic dispositions toward affectionate social behavior. (shrink)

Most studies investigating the relationship between cultural constructs and ethical perception have focused on individual- and societal-level values without much attention to other type of cultural constructs such as social beliefs. In addition, we need to better understand how social beliefs are linked to ethical perception and the level of analysis at which social beliefs may best predict ethical perceptions. This research contributes to the cross-cultural ethical perception literature by examining the relationship of individual-level social cynicism belief, one of five (...) universally endorsed social beliefs, together with individual social dominance orientation and the perception of unethical behavior. By means of two studies, we examine these relationships across societies that significantly differ on societal-level social cynicism belief. Using 371 business students from Russia and the U.S. in Study 1 and 268 professionals from Portugal and the U.S. in Study 2, we found that individual-level social cynicism belief was positively associated with social dominance orientation. Social dominance orientation, in turn, mediated the relationship between individual social cynicism belief and the perception of unethical behavior. Although we found significant societal-level differences in social cynicism belief in both studies, the relationships between individual-level social cynicism belief, social dominance orientation, and the perception of unethical behavior were structurally equivalent across societies in both studies, suggesting that societal-level differences did not significantly affect these relationships. Implications for cross-cultural business ethics research and practice are discussed. (shrink)

Despite the reported limited success of conventional treatments and growing evidence of the effectiveness of adult bariatric surgery, weight loss operations for (morbidly) obese children and adolescents are still considered to be controversial by health care professionals and lay people alike. This paper describes an explorative, qualitative study involving obesity specialists, morbidly obese adolescents, and parents and identifies attitudes and normative beliefs regarding pediatric bariatric surgery. Views on the etiology of obesity—whether it should be considered primarily a medical condition or (...) more a psychosocial problem—seem to affect the specialists’ normative opinions concerning the acceptability of bariatric procedures as a treatment option, the parents’ feelings regarding both being able to influence their child’s health and their child being able to control their own condition, and the adolescents’ sense of competence and motivation for treatment. Moreover, parents and adolescents who saw obesity as something that they could influence themselves were more in favor of non-surgical treatment and vice versa. Conflicting attitudes and normative views—e.g., with regard to concepts of disease, personal influence on health, motivation, and the possibility of a careful informed consent procedure—play an important role in the acceptability of bariatric surgery for childhood obesity. This article investigates discursive practices associated with the co-management of patients between healthcare providers. Specifically, we focus on two genres written by optometrists and ophthalmologists — two groups who are experiencing interprofessional tension over their scopes of practice. In our analysis we foreground four kinds of modality associated with verbs — epistemic, deontic, phatic and subjective. We found that these healthcare providers shared in the epistemic resources used to hedge their sense of clinical certainty, and that ophthalmologists used deontic resources (...) to control future action. However, we also noted that both professions used deontic, phatic and subjective resources to create dialogical space for each other to participate in some future relationship. In fact, one of the main points of this correspondence might be to establish personal relationships between practitioners. Unfortunately, however, this subtle use of modality to negotiate professional boundaries is fading as many ophthalmologists, due to workload issues, are not responding to referral letters or are converting their correspondence to form letters. ObjectivePrevious research has shown reduced interoceptive accuracy in depression. Attention deficit represents a key symptom of depression. Moreover, IAcc is positively correlated with attention. There is no study that investigates the effect of depression on IAcc and attention. The aim of this study is to examine the mediating effect of IAcc on depression and attention.MethodsThirty-six depressed patients from the Psychosomatic Clinic in Windach were matched with 36 healthy controls according to age and sex and were assessed at Ulm University. All (...) participants completed the Beck Depression Inventory-II, the heartbeat perception task to examine IAcc, and the d2 test assessing selective attention.ResultsDepressed patients showed attention deficits—both for general visual attention and IAcc—compared to healthy controls. The mediation analyses revealed that the relationship between depression and attention is not mediated via IAcc. Furthermore, depression predicts IAcc and attention, but these effects are direct and largely unaffected by the respective other variable.DiscussionThe results of the present study highlight both interoceptive as well as attention deficits in depressed patients. No clear mediation between these variables could be shown in this study. More elaborative research is needed to clarify whether different approaches to improve IAcc are effective for these deficits in depressed patients and could therefore be of importance as an additional aspect of therapy in depression. Rare copy number variants have a prominent role in the aetiology of schizophrenia and other neuropsychiatric disorders. Substantial risk for schizophrenia is conferred by large CNVs at several loci, including microdeletions at 1q21.1, 3q29, 15q13.3 and 22q11.2 and microduplication at 16p11.2. However, these CNVs collectively account for a small fraction of cases, and the relevant genes and neurobiological mechanisms are not well understood. Here we performed a large two-stage genome-wide scan of rare CNVs and report the significant association of copy (...) number gains at chromosome 7q36.3 with schizophrenia. Microduplications with variable breakpoints occurred within a 362-kilobase region and were detected in 29 of 8,290 patients versus 2 of 7,431 controls in the combined sample. All duplications overlapped or were located within 89 kilobases upstream of the vasoactive intestinal peptide receptor gene VIPR2. VIPR2 transcription and cyclic-AMP signalling were significantly increased in cultured lymphocytes from patients with microduplications of 7q36.3. These findings implicate altered vasoactive intestinal peptide signalling in the pathogenesis of schizophrenia and indicate the VPAC2 receptor as a potential target for the development of new antipsychotic drugs. © 2011 Macmillan Publishers Limited. I could use the company of younger people.” It had been about a year since I’d first been invited to these (...) Thursdays —monthly literary and musical soirees Marguerite hosted in her living room. Helen had been a regular at Marguerite’s for several decades; the two women were close contemporaries and each a celebrity in her own field. Helen was scholar of the English Romantics at the same university where Marguerite had taught Flaubert, Zola, and Balzac, and where I was now a junior faculty member in the English department. I’d heard of Professor More long before I met her: she lectured at the university from the 1960s until being forced into retirement in 2006 ostensibly due to age. She had a reputation as a militant feminist who eagerly engaged in battles about appointments and promotions, and her politics could have had something to do with it. “Are they sure it was a suicide?” In person Helen was a quiet, reticent woman with a sly, sarcastic sense of humor, and the idea that she might’ve committed suicide seemed outlandish. Vague murder scenarios floated in my mind. A disgruntled student? A male professor, passed over for promotion years ago and blaming her for his career failure? 96 Olga Zilberbourg “Yes, quite. The details are unpleasant, but do you know what she wrote in her suicide note?” “Of course she left a note.” “She said, ‘Thanks for the trip. Love to all.’” I couldn’t help laughing. “Yet when you think that having written that, she took all those pills and put a plastic bag over her head,” Marguerite’s voice broke. “Anyway, it’s not a conversation to have over the telephone. Do come over.” On Thursday afternoon, having collected the student papers after the last exam of the semester, I took the subway down to Greenwich Village. Marguerite lived on a third floor walkup, in a wonderfully spacious and tall-ceilinged apartment that back in the 1970s she and her husband had converted from a pillow factory. Since her husband’s death ten years earlier, the apartment had slowly turned into a trap for Marguerite. She suffered from arthritis in her hands, shoulders, and knees, and walking up and down the stairs became a nearly impossible exercise. She ventured out once or twice a week with the assistance of a visiting nurse. The place could easily fetch three or four million dollars, and Marguerite could use the money. The steady growth of the number of DNA tests offered results in the discussion on the ethical aspects of these tests becoming increasingly lively and multifaceted. This text provides an overview of selected issues concerning the characteristics, protection and quality of the information acquired as a result of carrying out DNA tests. I discuss the salient points in the debates on the possibility to justify the so-called genetic exceptionalism, and the ways of specifying the scope of the principle of confidentiality (...) that protects the privacy of the information given by the subject. The final part of the article features the discussion on the importance of the possibility to use the information, acquired from these tests, in practice – for making decisions about the introduction of new kinds of tests for the clinical application. We present a one per cent measurement of the cosmic distance scale from the detections of the baryon acoustic oscillations in the clustering of galaxies from the Baryon Oscillation Spectroscopic Survey, which is part of the Sloan Digital Sky Survey III. Our results come from the Data Release 11 sample, containing nearly one million galaxies and covering approximately 8500 square degrees and the redshift range 0.2 < z < 0.7. We also compare these results with those from the publicly released (...) DR9 and DR10 samples. Assuming a concordance Λ cold dark matter cosmological model, the DR11 sample covers a volume of 13 Gpc3 and is the largest region of the Universe ever surveyed at this density. We measure the correlation function and power spectrum, including density-field reconstruction of the BAO feature. The acoustic features are detected at a significance of over 7σ in both the correlation function and power spectrum. Fitting for the position of the acoustic features measures the distance relative to the sound horizon at the drag epoch, rd, which has a value of rd,fid = 149.28 Mpc in our fiducial cosmology. We find DV = at z = 0.32 and DV = at z = 0.57. At 1.0 per cent, this latter measure is the most precise distance constraint ever obtained from a galaxy survey. Separating the clustering along and transverse to the line of sight yields measurements at z = 0.57 of DA = and H =. Our measurements of the distance scale are in good agreement with previous BAO measurements and with the predictions from cosmic microwave background data for a spatially flat CDM model with a cosmological constant. © 2014 The Author Published by Oxford University Press on behalf of the Royal Astronomical Society. In today's conditions, the heavy resistance of Ukrainians to Russian aggression, which is carried out, with the exception of the military, by way of information and economic methods, and now also through a non-gossip "hybrid" confrontation, it is very important to properly evaluate and play an appropriate role in this religious and religious factor. "Russian World" is no less effective weapon of the Moscow Church in the war with Ukraine than the military aid of the Russian state to the separatists.. (...) Religious communities have their potential in educating citizens - patriots of their homeland, or else. Different aspects of the problem of the role of religious-church factors in patriotic education of Ukrainians have long been in the zone of justified attention of domestic secular scholars and representatives of the Churches, among them: A. Kolodny, L. Filippovich, V. Shevchenko, P. Pavlenko, O. Sagan, C. Zdioruk, M. Cherenkov, O. Tuyeshin and others. Particular attention of the RCC and Protestant Churches in this regard was given by P. The purpose of the study is to reveal the phenomenon of modern shamanism, founded by M. Harner. To define the problems of the emergence and development of shamanism as a primitive religion and its modern interpretation of terminology with its significance in the spiritual life of society. The article discusses a way of rebirth and transformation of shamanism due to the shaman's journey into a daily reality by building a complete picture of the world, that is, cartography. The scientific novelty (...) is that on the example of modern shamanism it is possible to prove the principle of the leadership qualities of the modern shaman, which help a modern person find support in the global world. Shamanism aims to preserve traditional knowledge and transfer to future generations. As a result, it was revealed that shamanism is able not only to form, but also to develop relations between man and nature. (shrink)

The article deals with the philosophical problem field of modern neuroethics. The general idea of the state of modern neuroethics is given and it is shown that research in this area encompasses both fundamental problems that classically belonged to the field of philosophy research (for example, such as the problem of psychophysical dualism, the physical bases of consciousness, freedom of will and its interrelation with brain activity) and problems with applied orientation, explicating the ethical-social and legal dimension of innovation development (...) in the field of neuroscience and actualizing the analysis of their social risks. It is shown that the development of neuro-ethics in the modern world became possible thanks to a special way of functioning of modern science, which was called the technology of science and to the development of the phenomenon of technological development ethification, which in practical terms was expressed in the study of the problem of the correspondence of the results of innovative scientific and technical projects to the interests of various social groups, their expectations and values, and also helped to determine the status of new technologies in relation to social reality. The article gives an idea of the existing normative field necessary for the development of neuro-ethics. On the basis of using the resource of discourse analysis of R. Harre, who singled out personal grammar (P-grammar), organism grammar (O-grammars) and molecular grammar (M-grammar), a philosophical analysis of such a problem of modern neuroethics as brain death was carried out. Also was given a structural description of new biotechnogenic identities of human being. The conclusion is drawn that the concept of brain death is an example of the conventional nature of scientific truth, the formation of which is influenced by various socio-cultural and economic factors. In the context of the development of neuroscience and the emergence of new methods of brain regeneration, it can be rethought. (shrink)

Here we discuss a “chromosome separation checkpoint” that might regulate the anaphase‐telophase transition. The concept of cell cycle checkpoints was originally proposed to account for extrinsic control mechanisms that ensure the order of cell cycle events. Several checkpoints have been shown to regulate major cell cycle transitions, namely at G1‐S and G2‐M. At the onset of mitosis, the prophase‐prometaphase transition is controlled by several potential checkpoints, including the antephase checkpoint, while the spindle assembly checkpoint guards the metaphase‐anaphase transition. Our hypothesis (...) is based on the recently uncovered feedback control mechanism that delays chromosome decondensation and nuclear envelope reassembly until effective separation of sister chromatids during anaphase is achieved. A central player in this potential checkpoint is the establishment of a constitutive, midzone‐based Aurora B phosphorylation gradient that monitors the position of chromosomes along the spindle axis. We propose that this surveillance mechanism represents an additional step towards ensuring mitotic fidelity. (shrink)
